ECHA launches Recommendation List consultation for five substances

Today, 7 February 2024, ECHA published its 12th Recommendation List, and a public consultation will commence. In the EU REACH Authorisation process, substances move from the Candidate List of Substances of Very High Concern (SVHC) to the Authorisation List through ECHA’s prioritisation and recommendation drafting process.  

Interested industries and stakeholders now have three months to provide evidence to ECHA regarding the included substances: 

  • Bis(2-ethylhexyl) tetrabromophthalate (EC no. 26040-51-7) 
  • Barium diboron tetraoxide (EC no. 13701-59-2) 
  • Diphenyl(2,4,6-trimethylbenzoyl)phosphine oxide (EC no. 75980-60-8) 
  • S-(tricyclo[5.2.1.02,6]deca-3-en-8(or 9)-yl) O-(isopropyl or isobutyl or 2- ethylhexyl) O-(isopropyl or isobutyl or 2-ethylhexyl) phosphorodithioate (EC no. 255881-94-8)
  • Melamine (EC no. 108-78-1) 

Companies using any substance affected by the draft 12th Recommendation List should take action and start considering their response. Meanwhile, those using substances listed in the adopted 11th Recommendation List should prepare for inclusion of those substances on the Authorisation List (REACH Annex XIV) expected later this year. Upon inclusion in Annex XIV, companies must either cease using the substance before a ‘sunset date’ or apply for authorisation before the ‘latest application date’.
